A judge has officially dismissed the third degree murder charge against Derek Chauvin, one of four former Minneapolis police officers charged with the death of George Floyd in May.

According to recent reports, Hennepin District Judge Peter Cahill ruled not only that Derek Chauvin’s third-degree murder charges should be dismissed, but that his second-degree murder and manslaughter charges remain. The verdict was passed earlier this week and was recently released for public viewing.

Judge Cahill said there were probable enough grounds on Chauvin’s murder and second degree charges to go to trial. Judge Cahill also denied defense motions to deny aid against the other three former officers, Thomas Lane, J. Kueng and Tou Thao.

“In this court’s view, the state has, with one exception, fulfilled its duty to provide a probable reason that any trial of any of these defendants is warranted for any criminal charges brought against them by the state,” wrote Judge Cahill. He said it was up to a jury to determine whether Chauvin and the other former officers were responsible for George Floyd’s death.

Earlier this month, 51 people were arrested in protests in Minnesota after Derek Chauvin was released on bail. He was held in a state prison instead of a local prison while awaiting trial in March.
